Course Objectives

Mediation confidentiality is important to every practicing litigator and mediator. Many cases go to mediation at least once. The California Supreme Court’s interpretation of mediation confidentiality is therefore relevant to many practitioners.

However, lawyers obviously sometimes lack the time to read new cases. So this presentation of the Cassel case is an opportunity for someone to go through a case that might not have been read by many people.  Hopefully, this will give a practitioner a reasonable idea of how the California Supreme Court appears to view mediation confidentiality currently.

The seminars covers:
1.  The mediation privilege statute
2.  Cassel at the trial level
3.  Cassel at the appellate level
4.  Cassel at the California Supreme Court level
